Judicial Review in Canadian Immigration
Judicial review in the Canadian immigration system is a crucial legal avenue overseen by the Federal Court. It serves to review decisions made by immigration officers, boards, or tribunals to ensure they comply with legal standards and procedural fairness. Unlike an appeal, judicial review does not re-examine the facts or evidence of your case but focuses on whether the decision was made within the decision-maker’s authority and was reasonable.
Understanding the Process
When applying for judicial review of your Canadian immigration application, you challenge a decision made by Immigration, Refugees and Citizenship Canada (IRCC) or the Immigration and Refugee Board (IRB) in the Federal Court of Canada. This process is intricate and demands specialized knowledge of immigration law, making legal representation essential for navigating its complexities effectively.
